TRAVELSAFE  PLUS INSURANCE TERMS, CONDITIONS AND EXCLUSIONS

INSURING CLAUSE

    The Insured and Blue Cross (Asia-Pacific) Insurance Limited (the "Company") agree:
  1. This Policy, the Insurance Certificate, the Schedule of Benefits and any Endorsements to this Policy shall be read together as one contract.
  2. The Terms, Conditions and Exclusions contained in the Insurance Certificate shall be read in accordance with and shall not be construed so as to modify, add to or in any way vary the terms, conditions and exclusions contained herein.
  3. The Proposal and Declaration is incorporated in and is the basis of this insurance contract.
  4. The Insured shall pay the premium specified in the Insurance Certificate.
  5. The Company shall provide insurance subject to the limits, terms, conditions and exclusions of this Policy.
  6. The due observance of the terms, conditions and endorsements of this Policy relating to anything to be done or not to be done or to be complied with by the Insured or any other person claiming to be indemnified; and the truth of the contents and statements in the Proposal and Declaration, shall conditions precedent to any liability of the Company.

    TERRITORIAL SCOPE OF INSURANCE COVER

    All benefits described in this Policy are subject to the following restrictions:
    1. For Super Diamond and Super Gold Plans - whilst the Insured Person is travelling anywhere other than Place of Origin as defined in this Policy.
    2. For China Plan - whilst the Insured Person is travelling in The People's Republic of China excluding Hong Kong.

     

    DEFINITIONS

    1. "ACCIDENT" shall mean an event occurring entirely beyond the Insured Person's control and caused by violent, external and visible means.
    2. "BLUE CROSS WORLDWIDE EMERGENCY AID" shall mean medical assistance or related services offered by the Company or its authorized representatives.
    3. "CHINESE MEDICINE PRACTITIONER" shall mean any Chinese bonesetter, acupuncturist or practitioner who is legally registered with the Chinese Medicine Council of Hong Kong according to the Chinese Medicine Ordinance, but excluding a Chinese Medicine Practitioner who is the Insured Person or an Immediate Family Member of the Insured Person.
    4. "CLOSE BUSINESS PARTNER" shall mean a business associate that has a share in the Insured Person's business.
    5. "CONTENTS" shall mean all the Insured Person's furniture, furnishings, home appliances, household and personal effects including household appliances hired to the Insured Person or the Insured Person's Family Members.
    6. "ELIGIBLE EXPENSES" in respect of medical expenses shall mean those expenses necessitated by an Accident or a Sickness/disability covered by this Policy and incurred on the recommendation of a Surgeon or Physician but not to exceed normal and customary charges for the same. The Eligible Expenses shall not in any event exceed the actual charges incurred.
    7. "HONG KONG" shall mean Hong Kong Special Administrative Region.
    8. "HOSPITAL" shall mean only an establishment duly constituted and registered as a hospital for the care and treatment of sick and injured persons as paying bed-patients, and which has all of the following:
      1.   facilities for diagnostic procedures and surgery;
      2.   24 hours a day nursing services by registered graduate nurses;
      3.   is under the supervision of a Physician, and is not primarily a clinic; a place for alcoholics or drug addicts; a nursing, rest or convalescent home;or a home for the aged or similar establishment.
    9. "HOSPITAL CONFINEMENT" OR "CONFINED" shall mean being confined in a hospital for medical treatment for a minimum period of 24 hours upon the recommendation of a Physician for continuous stay in the hospital prior to his/her discharge.
    10. "IMMEDIATE FAMILY MEMBER" shall mean an Insured Person's legal spouse, children, parents, parents-in-law, brothers or sisters, grandparents, grandchildren, legal guardian.
    11. "INJURY" shall mean any bodily injury arising from an Accident as defined above, which solely and independently of any other cause (i) results in death within 12 calendar months of the date of the event or (ii) necessitates medical and/or surgical treatment.
    12. "INSURED PERSON" wherever used in this Policy or Insurance Certificate shall mean the persons named as Insured in the Policy Schedule or Insurance Certificates or by way of subsequent endorsement to the Policy.
    13. "JOURNEY" shall mean the period of travel commencing when the Insured Person leaves the immigration counter/office at Place of Origin on the departure date specified in the Insurance Certificate for the purpose of commencement of his/her insured Journey and until the expiry of the Period of Insurance specified in Insurance Certificate or the Insured Person's arrival at any immigration counter/office for returning to Place of Origin after the insured Journey, whichever first occurs.
    14. "LOSS OF HEARING" shall mean permanent irrecoverable loss of hearing where:
      1. dB=Hearing loss at 500 Hertz.
      2. dB=Hearing loss at 1000 Hertz.
      3. dB=Hearing loss at 2000 Hertz.
      4. dB=Hearing loss at 4000 Hertz.
      5. 1/6 (a+2b+2c+d) is above 80 dB.
    15. "LOSS OF LIMB" shall mean loss by physical severance at or above the wrist or ankle joint.
    16. "LOSS OF SIGHT" shall mean the entire and permanent irrecoverable loss of sight.
    17. "LOSS OF SPEECH" shall mean the disability in articulating any three of the four sound which contribute to the speech such as the Labial sounds, the Alveololabial sounds, the Palatal sounds and the Velar sounds or total loss of vocal cord or damage of speech centre in the brain resulting in Aphasia.
    18. "LOSS OF USE" shall mean total functional disablement.
    19. "PERIOD OF INSURANCE" shall mean the period of time specified in the Insurance Certificate during which this Policy is effective.
    20. "PERMANENT TOTAL DISABLEMENT" shall mean a result of an Accident that prevents the Insured Person from attending to his/her normal occupation for a minimum of 52 consecutive weeks certified at the end of that time by a Physician acceptable to the Company to be a condition that will permanently and totally disable the Insured Person from engaging in any gainful occupation and that is beyond any hope of improvement.
    21. "PERSONAL EFFECTS" shall mean articles of personal possession normally worn or carried and belongs to the Insured Person.
    22. "PHYSICIAN" OR "SURGEON" shall mean only a person qualified by a degree in Western Medicine and duly licensed or legally authorized by the Government with jurisdiction in the geographical area of his/her practice to render medical or surgical service, but excluding a Physician who is the Insured Person or an Immediate Family Member of the Insured Person.
    23. "PLACE OF ORIGIN" shall mean the place where the Journey of an Insured Person commences. Place of Origin will be considered to be Hong Kong unless otherwise specifically mentioned on the application form by the applicant.
    24. "POLICY" shall mean and refer to the entire Policy document between the Insured and the Company including Application, Proposal, Declaration or Beneficiary Designation Form submitted or made by the Insured Person, the Terms and Conditions, the Schedule of Benefits, Insurance Certificates issued hereunder and any endorsements thereto.
    25. "PRE-EXISTING CONDITION" shall mean any injury, sickness, disease or physical condition which existed before the issue date of Insurance Certificate in respect of the Insured Person, which presented signs or symptoms of which the Insured Person was aware or should reasonably have been aware.
    26. "PRESCRIBED MEDICINES" OR "DRUGS" shall respectively mean any medicine or drug for which a Physician's prescription has been issued and has been dispensed by a Physician's surgery or by a licensed pharmacist in respect of treatment covered under this Policy.
    27. "PUBLIC CONVEYANCE" shall mean all public common carrier such as multi-engined aircrafts, buses, trains, ships, hovercrafts, ferries and taxis that are licensed (other than a contractor or private carrier) which any member of the public can join at a recognised stop and pay a fare.
    28. "SERIOUS BODILY INJURY OR SICKNESS" shall mean one which requires treatment by a Physician and certified by that Physician as being dangerous to life and unfit to travel or continue with his/her Journey.
    29. "SICKNESS" shall mean a condition marked by a deviation from the normal healthy state of human being.
    30. "ACT OF TERRORISM" shall mean an act, including but not limited to the use of force or violence and/or the threat thereof, of any person or group(s) of persons, whether acting alone or on behalf of or in connection with any organisation(s) or government(s), committed for political, religious, ideological or similar purposes including the intention to influence any government and/or to put the public, or any section of the public, in fear.


    POLICY BENEFITS

    Note:  All Benefits payable to the Insured Person (or his/her legal representative) pursuant to
    Sections 1-15 below are subject to the maximum limits and sub-limits as stated in the Schedule of Benefits for the plan selected for the Insured Person, AND subject to the terms, conditions and exclusions of the Policy herein.






    SECTION 1 "MEDICAL EXPENSES" BENEFIT
    Eligible Expenses are payable for the following itemised medical services and treatment arising from the Insured Person's Injury or Sickness contracted or sustained during the Journey:

    1. Hospitalisation, surgery, ambulance and paramedic services, diagnostic tests, consultation by Physicians and Prescribed Medicines.
    2. Follow up Medical Expenses
      Medical treatment by the Insured Person within 90 days of his/her return to Hong Kong from overseas
      PROVIDED THAT Hong Kong is the final destination of the Journey. Follow up Medical Expenses under
      this section includes treatment from a Chinese Medical Practitioner for Chinese Bone-setting and
      Acupuncture arising from accidental Injury.


    Additional Exclusions Applying to Section 1
    The Company will not be liable for:
    1. expenses related to special or private nursing.
    2. expenses related to cosmetic surgery, apparatus to correct visual acuity or refractive error, contact lenses, glasses or hearing aids, and medical equipment and accessories.
    3. expenses related to psychiatric, psychological disorder and insanity (including any related primary/basic signs and symptoms).
    4. expenses related to any form of delivery from a pregnancy, as well as expenses for any pregnancy complications except such complications require hospitalisation up to the 30th week of the pregnancy.
    5. expenses related to any and all conditions arising from surgical, mechanical or chemical methods of birth control and any and all conditions or treatments pertaining to infertility unless caused by an Injury or Sickness sustained during the Journey.
    6. expenses related to treatment or services undertaken without the related recommendation of a Physician; routine physical examinations or health check-ups not incidental to the treatment or diagnosis of a suspected covered Injury or Sickness sustained during the Journey covered by this Policy and occurring or arising during the Period of Insurance.
    7. medical and related expenses incurred after 180 days of the date of the Accident or Sickness/disability contracted or sustained.
    8. any medical expenses related to travel taken contrary to the advice of a medical practitioner or where the Journey is for the purpose of receiving medical or surgical treatment.

    SECTION 2 "OVERSEAS HOSPITAL CASH ALLOWANCE" BENEFIT
    Payable for each complete day (i.e. 24 hours) of the Insured Person's Hospital Confinement as an in-patient during the Journey. For the avoidance of doubt, no payments will be made for confinements less than 24 hours.

    SECTION 3 "24-HOUR EMERGENCY SERVICES"
    Blue Cross Worldwide Emergency Aid
    Emergency Medical Assistance - In the event of a Serious Bodily Injury or Sickness requiring hospitalisation abroad, the Insured Person may contact "Blue Cross Worldwide Emergency Aid" by telephone or fax if assistance is needed in the following: 
    1. Emergency Evacuation
      Assistance in respect of the Insured Person to the nearest medical facility, if immediate treatment is required and adequate medical facilities are not available at the place of Accident or Sickness.
    2. Repatriation
      The necessary repatriation of the Insured Person to the medical facility in his/her Place of Origin following Emergency Evacuation in 1 above by scheduled airline flight or other appropriate means of transportation if his/her original ticket is not valid for travel, PROVIDED THAT the Insured Person shall surrender any unused portion of his/her ticket to the Company. Any decision on what constitutes 'necessary' repatriation of the Insured Person shall be made jointly and exclusively by both the attending Physician and the Company.
    3. Hospital Deposits Guarantee
      To guarantee or pay any required hospital admittance fees on behalf of the Insured Person and such amount shall be deducted from the "Medical Expense" Benefit.
    4. Additional Costs of Travel and Accommodation
      Additional costs of economy class travel returning to the Place of Origin for the Insured Person and additional costs of accommodation incurred by the Insured Person or a travelling companion who is also insured under this Policy are payable, when such costs arise from Serious Bodily Injury or Sickness necessitating medical treatment of an Insured Person.
    5. Family Member Visit
      Reasonable additional accommodation and travelling expenses payable for two Immediate Family Members to join the Insured Person if he/she is confined in a hospital for more than 3 days or has died abroad.
    6. Return of Insured Children
      Reasonable additional accommodation and travelling expenses for the return to the Place of Origin of the Insured Person's dependent children (aged below 18) who are left unattended overseas as a result of Serious Bodily Injury or Sickness or hospitalization of the Insured Person.
    7. Repatriation of Mortal Remains
      Transportation charges for the repatriation of the mortal remains of the Insured Person to the Place of Origin.
    8. Burial and Funeral Expenses
      Necessary Burial and Funeral formalities due to the Insured Person's death.
    9. Referral Services
      Upon request of the Insured Person, referral services such as legal assistance, interpreter, obtaining replacement of lost travel document or air-ticket etc. can be provided through "Blue Cross Worldwide Emergency Aid".

    Note: The Company's prior approval on items 1, 2, 3 & 7 need to be obtained by the Insured Person or his/her representatives before any assistance or payment of deposits is guaranteed.

    Procedure: In the event of the above, the Insured Person or his/her representatives shall call our "Blue Cross Worldwide Emergency Aid" for 24-hour emergency assistance.

    The party making such call will be required to identify the Insured Person's Name, his/her Certificate Number and Hong Kong Identity Card or Passport Number as well as nature of problem, the location and contacts. After validation, the Company or its authorised representatives, will provide services and settle bills as required by the terms and conditions of this Policy through "Blue Cross Worldwide Emergency Aid".


    SECTION 4 "PERSONAL ACCIDENT" BENEFIT
    1. The following benefits are payable in the event of an Accident on the Journey resulting in the Insured Person's death or permanent disablement as specified in the table (i.e. "Insured Event") below. If more than one Insured Event occurs to the Insured Person on the Journey, the benefits payable under this section are limited to 100% of the Sum Insured.

    2. The Sum Insured in respect of children under 18 years of age and persons over 70 years of age shall not exceed HK$150,000.

    3. EXTENSION OF PERSONAL ACCIDENT BENEFITS
        Benefits under this section are payable in the event of an Accident causing an Insured Event to an Insured Person whilst travelling on
        a direct route:

    1. from his/her residence or regular place of employment in the Place of Origin to the immigration counter within 3 hours of the scheduled departure time of the Public Conveyance, for the purposes of commencement of the Journey.
    2. from the immigration counter to his/her residence or regular place of employment in the Place of Origin within 3 hours of the scheduled arrival time upon completion of the Journey.

    4. DOUBLE BENEFITS:
        The amounts payable pursuant to section 4.1 above shall be doubled if the Accident causing the Insured Event occurred
        while the Insured Person is travelling as a fare paying passenger on board a Public Conveyance and coach arranged by
        the travel agency PROVIDED THAT no benefit will be payable under this extension:

    1. when the Insured Person has made any statement that disclaims or discharges the liability of the Public Conveyance; or
    2. for any Injury or death attributable to any Act of Terrorism.

    5. If the whereabouts of an Insured Person cannot be located within one year after the date of the disappearance, sinking 
        or wrecking of an aircraft or other conveyance either on the ground or at sea in which the Insured Person was travelling
        in the Journey, it will be presumed that the Insured Person suffered an accidental death for the purposes of this section.

    6. In the event of the death of an Insured Person giving rise to a claim under this section, the benefit shall be paid
        to the Insured Person's estate according to the laws of Hong Kong.

    Additional Exclusions Applying to Section 4
    The Company will not be liable for:
    1. loss caused by an Injury which is a consequence of any kind of disease or Sickness.

    SECTION 5 "MAJOR BURNS" BENEFIT
    Payable for Third Degree Burns, that is the destruction of the skin to its full depth and damage to the tissues beneath with burnt areas equal to or greater than 5% of the Insured Person's total body surface area. PROVIDED THAT the assessment of the burns is certified by a Physician with medical reports and full diagnosis.

    SECTION 6 "CANCELLATION CHARGES" BENEFIT
    Payable where deposits or any payments forfeited for tours or airfare or other travel arrangements and are irrecoverable from the tour operator or airline concerned upon cancellation prior to the Journey as a direct result of:
    1. death, Serious Bodily Injury or Sickness of the Insured Person or the Immediate Family Members, Close Business
        Partner, a travelling companion who is also insured with the Company under the same Journey.
    2. compliance with a witness summons, jury service or compulsory quarantine of the Insured Person.
    3. serious damage to the Insured Person's principal home in Hong Kong arising from fire or flooding within 10 days from
        the scheduled departure date which requires the Insured Person's continued presence on the premises.

    Additional Exclusions Applying to Section 6
    The Company will not be liable for:
    1. any loss arising out of pregnancy or gynaecological disease or their sequelae.
    2. any loss arising out of any Act of Terrorism.
    3. any loss due to medical or physical conditions or other circumstances affecting the Insured Person, or Immediate Family Members or travelling companion, Close Business Partner of the Insured Person known to exist at the time of issue of the Insurance Certificate.

    SECTION 7 "CURTAILMENT OF TRIP" BENEFIT
    Payable against loss on a pro-rata basis for each complete day of the unused portion of pre-paid travel fare or accommodation deposit included in the contracted holiday or Journey arising from necessary and unavoidable curtailment of the holiday or Journey and the additional public transportation expenses returning to the Place of Origin (based on economy class fare for any transportation mode) as a direct result of:
    1. death, Serious Bodily Injury or Sickness of the Insured Person or the Immediate Family Members, Close Business Partner, a travelling companion who is also insured with the Company under the same Journey.
    2. hijack of an aircraft or conveyance or coach arranged by travel agency in which the Insured Person is travelling as a fare-paying passenger.
    3. natural disaster at the planned destination of the Journey which prevent the Insured Person from continuing with the Journey.

    Additional Exclusions Applying to Section 7
    The company will not be liable for:
    1. any loss arising out of pregnancy or gynaecological disease or their sequelae.
    2. any loss arising out of any Act of Terrorism.
    3. any loss due to medical or physical conditions or other circumstances affecting the Insured Person, or Immediate Family Members or travelling companion, Close Business Partner of the Insured Person known to exist at the time of issue of the Insurance Certificate.

    SECTION 8 "TRAVEL DELAY" BENEFIT
    Benefits A or B stated below payable in the event the Insured Person's scheduled Public Conveyance is delayed for at least 6 hours during the Journey due to adverse weather conditions, natural disasters, Act of Terrorism, industrial action, hijack, technical or other mechanical breakdown or derangement of aircraft or Public Conveyance until the Journey recommences on the first available alternative transportation offered by the carrier or Public Conveyance.

    1. Up to a maximum limit stated in the Schedule of Benefits of the plan selected in respect of Public Conveyance expenses by alternative means on the same class as a direct consequence of travel delay, OR
    2. Insured Person may claim up to HK$250 for an initial delay of at least 6 consecutive hours and HK$250 for each subsequent 6-hour period up to a maximum limit stated in the Schedule of Benefits of the plan selected.

    A claim can only be made under item (A) or (B).

    Additional Exclusions Applying to Section 8
    The Company will not be liable if:
    1. the travel delay arises from an act of omission on the part of the Insured Person, including the failure to confirm the advanced booking or check in or arrive at the departure gate at the scheduled time before departure.
    2. the Insured Person has not secured a confirmed advanced booking prior to the commencement of an industrial action, adverse weather conditions, natural disaster, Act of Terrorism, hijack or breakdown of aircraft or Public Conveyance concerned.

    SECTION 9 "BAGGAGE DELAY" BENEFIT
    Payable where the Insured Person suffers temporary deprivation of baggage for at least 6 hours from the time of arrival at destination abroad due to delay or misdirection in delivery during the Journey.

    Additional Exclusions Applying to Section 9
    The Company will not be liable:
    1. if the delay has not been certified by an official "Property Irregularity Report" from the airline or in writing from the tour operator.
    2. the delay is as a result of detention or confiscation by customs or other law enforcing officials.
    3. under this section if the same loss is claimed for under Section 10 of "Baggage" Benefit of this Policy.
    4. any loss which occurred after the Insured Person returns to the Place of Origin or reaches his/her final destination.

    SECTION 10 "BAGGAGE" BENEFIT
    Payable where any loss, physical breakage or damage occurs to the Insured Person's baggage or personal property owned and carried on the Journey directly resulting from theft, robbery burglary, accident or mishandling by carriers. The Company shall at its option pay the benefit under this section for such loss or damage, or the costs for repair or replacement of such lost or damaged baggage or personal property. PROVIDED THAT:
    1. the Insured Person shall take reasonable precautions to ensure the safety of the property insured, including to
        safeguard his/her accompanied baggage or personal property and not leave them unattended in a public place.
    2. all baggage is to be examined when received.

    Additional Exclusions Applying to Section 10
    The Company will not be liable for:
    1. loss or damage in consequence of delay, confiscation, detention or examination by customs authorities or other officials.
    2. loss of cash, banknotes, negotiable instruments, bonds or securities, deeds, plastic money (including credit cards and Octopus cards etc.) and other instruments of payment or documents of any kind, passports, visas, air tickets, and transportation, accommodation or any other travel vouchers or coupons.
    3. loss of or damage to any pager, portable telecommunication equipment, computer equipment, software and accessories.
    4. loss of or damage to fragile or brittle articles of every description, china, glassware, porcelains, objects of art, set and unset precious or semiprecious gemstones or foodstuff.
    5. loss of or damage caused by wear and tear, moth, vermin or inherent vice, mechanical, electrical or electronic breakdown or derangement, faulty design or workmanship, cleaning, repairing or restoring process, atmospheric or climatic changes, depreciation in value and such depreciation shall be applied wholly at the discretion of the Company.
    6. loss of or damage to business merchandises or samples.
    7. loss of or damage to any baggage or personal property that is left behind or unattended in a Public Conveyance or public place.
    8. loss of or damage to Insured Person's baggage sent in advance or articles mailed or shipped separately.
    9. loss of jewellery unless such loss occurs while such jewellery is being worn or hand carried by the Insured Person or is being stored in a hotel safety deposit box.
    10. loss by any mysterious disappearance.
    11. loss or damage while in the custody of Public Conveyance or hotel, unless reported immediately on discovery in writing to such common carrier or hotel within 24 hours and a "Property Irregularity Report" is obtained in the event of loss occurred in an airline.
    12. any loss not reported to the local police within 24 hours of the discovery of the loss.
    13. any claim for damaged personal property unless the Insured Person can produce physical evidence for inspection by the Company.

    SECTION 11 "LOSS OF TRAVEL DOCUMENTS" BENEFIT
    The cost of obtaining replacement of passports, travelling tickets or pass and travel documents, as well as additional transportation of economy class and/or hotel accommodation expenses reasonably incurred in effecting such replacements, are payable if an Insured Person loses his/her passports, travelling tickets or pass and travel documents arising from theft, robbery, burglary and accidental loss during the Journey.

    Additional Exclusions Applying to Section 11
    The Company will not be liable for:
    1. any loss which the Insured Person fails to report to Police within 24 hours or as soon as practicable upon discovery of such loss.
    2. any loss contributed to by the Insured Person leaving the passports, travelling tickets or pass and travel documents unattended in a public place.
    3. loss of any travel documents which are not necessary to complete the Journey.

    SECTION 12 "PERSONAL MONEY" BENEFIT
    Payable for losses of Insured Person's personal money in the form of banknotes, cash or travellers cheques directly arising only from theft, robbery or burglary during the Journey.

    Additional Exclusions Applying to Section 12
    The Company will not be liable for:
    1. any loss which the Insured Person fails to report to Police within 24 hours or as soon as practicable upon discovery of such loss.
    2. loss or travellers cheques not immediately reported to the local branch of agent of the issuing authority.
    3. any loss or shortages of personal money arising due to an error or omission by any third party, any fluctuation in any rate of currency exchange, devaluation, or confiscation by any governmental authorities of any kind.
    4. any loss of plastic money (including credit cards, Octopus cards etc.) or securities.
    5. if the Insured Person contributed to his/her own loss by leaving the personal money unattended in a public place.
    6. any loss occurring to children below 10 years of age.

    Extensions of cover to SECTIONS 11 and 12
    Emergency Cash Assistance
    If the Insured Person requires emergency cash assistance in The People's Republic of China as a result of a covered loss under Sections 11 and 12, the Company will provide an emergency cash in advance to the Insured Person through the designated branches of The Bank of East Asia in China. PROVIDED THAT:
    1. the maximum amount payable for each Insured Person under this extension during the Period of Insurance under Sections 11 and 12 is limited to the amount of loss or HK$500 whichever is the less.
    2. any payment made hereunder shall be deducted from the indemnity payable under these sections.
    3. prior approval has to be given by the Company before any assistance is provided.
    4. emergency cash should be drawn from The Bank of East Asia within 3 days after the application is approved.

    SECTION 13 "PERSONAL LIABILITY" BENEFIT
    Payable for the Insured Person's legal liability to a third party (inclusive of legal costs and expenses) for:
    1. accidental bodily injury to a third party, or
    2. accidental loss or damage to third party's property, as a direct result of the Insured Person's negligence to the third party occurring during the Journey.

    Additional Exclusions Applying to Section 13
    The Company will not be liable for any liability, loss or claim:
    1. where the Insured Person or his/her authorised representative has admitted liability or entered into any agreement or settlement without notifying and obtaining the prior written consent of the Company.
    2. in respect of loss or damage to properties belonging to or in the care, custody or control of the Insured Person.
    3. arising directly or indirectly from:
      1. employers' liability, contractual liability or liability to the Immediate Family Members of an Insured Person;
      2. pursuit of a trade business or profession;
      3. ownership or occupation of lands or buildings (other than occupation only of any temporary residence);
      4. ownership, possession, hire, use or operation of vehicles, aircraft, watercraft or weapons;
      5. legal costs or penalties resulting from any criminal proceedings;
      6. bailment, contractual licences or conveyances of real estate or personal property.

    SECTION 14 GOLFER "HOLE-IN-ONE" BENEFIT
    One-off bar expenses payable in the event of the Insured Person achieving a 'hole-in-one' whilst playing in a competition or friendly game at any recognised golf courses during the Journey on that particular day.

    Additional Exclusions Applying to Section 14
    The Company will not be liable if:
    1. the Insured Person does not supply the bill of bar expenses with a properly authenticated certificate of the 'hole-in-one' and the expenses issued by the recognized golf club.
    2. the Insured Person is below the age of 18.
    3. the Insured Person is a professional golfer.

    SECTION15 "LOSS OF HOME CONTENTS" BENEFIT
    The cost of replacement or repair of the Insured Person's household contents or personal effects is payable if the Insured Person suffers loss of or damage to same as a result of burglary to the Insured Person's principal home in Hong Kong accompanied by forcible and violent entry to or exit from the premises leaving visible marks whilst the home is unoccupied during the Journey.

    Additional Exclusions Applying to Section 15
    The Company will not be liable for:
    1. loss due to use of any key or duplicate thereof irrespective whether the key belongs to the Insured Person or not.
    2. loss caused or facilitated by the reckless or wilful act of the Insured Person or the Insured Person's family members.

    GENERAL EXCLUSIONS
    This policy does not cover the following:
    1. Where the loss, costs or expenses are recoverable from any other insurance, whether such other insurance is stated to be primary, contributory, excess, contingent or otherwise. (This does not apply to the Personal Accident and Hospital Cash Benefit Sections of this Policy)
    2. Loss arising from a direct or indirect consequence of:
      1. pre-existing, congenital or hereditary conditions;
      2. any Injury, Sickness, death, loss, expense or other liability attributable to HIV (Human Immunodeficiency Virus) and/or any HIV related illness including AIDS (Acquired Immune Deficiency Syndrome) and/or any mutant derivative or variations thereof howsoever caused;
      3. war (whether declared or not), invasion, act of foreign enemies, civil war, revolution, civil unrest, performing duties as a member of armed forces, or other law enforcing agencies;
      4. any wilful, malicious, unlawful or deliberate act of the Insured Person or his/her family member;
      5. suicide, attempted suicide or intentional self-inflicted bodily Injuries, insanity, abortion, miscarriage, child-birth, venereal and sexually transmitted diseases, the use of alcohol or drugs other than those prescribed by a Physician; dental treatment unless resulting from Injury to sound and natural teeth;
      6. nuclear fission, nuclear fusion or radioactive contamination;
      7. accidents whilst engaging in any sport or game in a professional capacity where an Insured Person would or could earn income or remuneration from engaging in such sport or game; racing of any kind (other than on foot), and competition;
      8. accidents whilst engaging in any kind of manual labour work either in business or leisure or hazardous work engaging in offshore activities including commercial diving, oil rigging, mining, handling of explosives, site working, stunt works and aerial photography;
      9. flying as a pilot or member of the crew of any aircraft either for leisure or business;
      10. trekking at an altitude limit greater than 5,000 meters above sea level or scuba diving to a depth greater than 30 meters below sea level;
      11. losses which are indirect and consequential in nature except herein provided.

    GENERAL CONDITIONS
    1. Non-Cancellation by Insured - The Insurance Certificate issued under this Policy is non-cancellable by the Insured Person. No refund of premium will be made once the Insurance Certificate has been issued.
    2. Automatic Extension - The Policy cover provided will be automatically extended for a maximum period of 10 days in the event that the Insured Person is unavoidably delayed in the course of his scheduled itinerary as stipulated prior to departure.
    3. Extension of Period - Extension of Period of Insurance is allowed but subject to an additional premium and the Company's prior approval.
    4. No Direct Billing - There is no direct billing provided under this Policy except as arranged through Blue Cross Worldwide Emergency Aid and approved by the Company.
    5. Minimum and Maximum Age of Insured - The minimum age for persons(s) to be insured under this Policy is 6 weeks, up to a maximum age of 85 years. No benefit will be provided once the Insured Person reaches the age of 86. All children under the age of 18 years must obtain consent from their parents or legal guardian.
    6. Recovery from Insured where charges exceed Benefit - If the emergency or other services under this Policy are utilised, and the total charges exceed the total amount payable under the applicable limit of the Schedule of Benefits, the Insured Person shall be liable for such portion of costs exceeding the applicable limit.
    7. Pair and Set - In the event of loss of or damage to any article which is a part of a set, the measure of loss of or damage to such an article shall be a reasonable and fair proportion of the total value of the set and will not be construed to mean a total loss of the set. (Note: camera body, lenses and accessories will be treated as a set.)
    8. One Set of Benefits - An Insured Person can only be covered under one Insurance Certificate/Policy for the same Journey. If the Insured Person(s) is/are covered under more than one Insurance Certificate/Policy (except the free insurance provided by the travel agent) underwritten by the Company for the same Journey, the liability of the Company in respect of any one Insured Person for the same Journey is limited to the maximum benefits payable under one Insurance Certificate.
    9. Validity of Policy - This Policy is only valid for leisure travel or business travel (limited to administrative and non-manual works only).
    10. Itinerary - For Super Diamond and Super Gold Plans, the Journey shall include Hong Kong or such travel arrangements must be made and paid in Hong Kong; for China Plan, the Journey must depart from Hong Kong or Macau and such travel arrangements must be made and paid in Hong Kong.
    11. Jurisdiction Clause - The indemnity under this Policy shall not apply in respect of judgements which are not in the first instance delivered by or obtained from a court of competent jurisdiction within Hong Kong.
    12. Governing Law - This Policy and/or the Insurance Certificate shall be issued at the Hong Kong and shall be governed and construed in accordance with the laws of Hong Kong and any dispute or difference that arises under this Policy shall be settled in accordance with the laws of Hong Kong.
    13. Arbitration Clause - All differences arising out of this Policy shall be determined by arbitration in accordance with Arbitration Ordinance and the laws of Hong Kong. If the parties fail to agree upon the choice of the arbitrator, then the choice shall be referred to the Chairman for the time being of the Hong Kong International Arbitration Centre. It is expressly stipulated that it shall be a condition precedent to any right of action or suit upon this Policy that an arbitration award shall be first obtained. If the Company shall disclaim liability for any claim and such claim shall not within 12 calendar months from the date of such disclaimer have been referred to arbitration under the provisions herein then the claim shall for all purposes be deemed to have been abandoned and shall not thereafter be recoverable.
    14. Subrogation - The Company has the right to proceed at its own expense in the name of an Insured against third parties who may be responsible for any occurrence giving rise to a claim under this Policy and any amount so recovered shall belong to the Company.

    CLAIMS PROCEDURE AND CONDITIONS
    1. Fraudulent Claims
      If any claim under this Policy shall be in any respect fraudulent or exaggerated or if any fraudulent means or devices shall be used by the Insured Person or anyone acting on the Insured Person's behalf to obtain benefit under this Policy, the Company shall be under no liability in respect of such claim.
    2. Notice of any claim must be given to the Company within 30 days of the expiry of this Policy, and in the instance of a claim under the Personal Liability section of this Policy such notice must be given in writing as soon as possible and in any event not later than 14 days after the incident which may give rise to such a claim. All claims shall be made together with satisfactory proof to the Company in the case of death, Sickness, disability, Injury or loss for which a claim is made hereunder and shall be rendered at the Insured Person's own expense.
    3. All claims must be submitted with comprehensive supporting information including:
      1. In the case of "Personal Accident" and "Major Burns":
        1. Hospital and/or Physician's reports giving details on the nature of the Injury and the extent and period of disability;
        2. police reports where relevant and if death shall have resulted, a copy of the death certificate and the relevant coroner's report.
      2. In the case of "Medical Expenses", "24 Hours Emergency Services", "Hospital Cash Benefit","Cancellation Charges" and "Curtailment of Trip":
        1. all bills, receipts, tickets, coupons, contracts or agreements relevant to the claim;
        2. in respect of medical treatments, a full Physician's report and official documentation from the hospital or clinic stating the diagnosis of the condition treated and the date the Sickness, disability and/or Injury commenced, date, time, duration and place of such hospitalisation;
        3. a summary of the course of treatment including Prescribed Medicines and services rendered.
      3. In the case of Loss, Breakage or Damage to "Baggage", "Baggage Delay", "Personal Money", "Loss of Travel Documents" and "Loss of Home Contents":
        1. reports to the Police and/or relevant authorities must be made immediately and in any event no later than 24 hours after the loss occurrence;
        2. a copy of an notification to the operator of Public Conveyance and their official acknowledgment in writing or a "Property Irregularity Report" from an airline when loss or damage has occurred in transit;
        3. certified written copy of police report when loss or damage has occurred;
        4. all details including receipts as to date of purchase, price, model and type of items lost or damaged.
      4. In the case of "Emergency Cash Assistance":
        1. if emergency cash assistance is required, please contact "Blue Cross Worldwide Emergency Aid";
        2. provide the Insured Person's Certificate number, name, Hong Kong Identity Card or Passport number for validation  and approval;
        3. the original loss report obtained from the police of The People's Republic of China.
      5. In the case of "Travel Delay":
        1.   official documentation from the operator of Public Conveyance giving the cause, date, time and the duration of the delay.
      6. In the case of "Personal Liability":
        1. immediate written notification to the Company of the possible claim indicating the nature and circumstances of the incident or event;
        2. written confirmation that no admission of liability has been made and that no settlement has been made or agreed to without the prior knowledge and written consent of the Company;
        3. full documentation, including copies of the summons, court documents, solicitors' and other legal correspondence, letters of demand, must be submitted to the Company as soon as possible.
    4. The Company will be entitled to decline to take over and conduct of the Defence or settlement or handling of any claim if there have been a breach of the Policy terms and conditions.
    5. Incomplete claim forms will be returned to the claimant and any insufficiency of supporting information or documentation will result in delays in processing the claim.
    6. The Company shall not accept liability for any claim if the required information is not received within 60 days from the issue date of any written request from the Company requesting such further information, and the claim is thereafter deemed to be abandoned.
    7. In the event the Company is entitled to repudiate or refuse indemnity under this Policy, any amounts paid pursuant to any such claim shall be fully refunded by the Insured Person to the Company upon its demand.
